CV. Pondok Berkat Sejahtera operating as Stay in Villa or SiV acting as an Agent. The person or persons who provide payment on account of a booking are hereafter referred to as the “Vacationer”. “Owner” refers to the legal owner of the Property or Villa, and “Property or Villa” refers to the real property, its contents and related amenities rented to the Vacationer.
The terms and conditions below are applicable to all villa rental reservations made through websites owned and operated by Stay in Villa.

  1. BOOKING DEPOSIT/PAYMENT POLICY 
    A 50% Booking Deposit of the total Rental, Tax and Cleaning Charge is required to confirm the reservation. The balance, including the refundable security deposit, is due 75 days prior to arrival in all seasons. Any reservations made within 75 days of arrival are due in full in order to have a confirmed reservation. In some cases, we might require full payment to be settled in advance for bookings under special condition as such; non-cancellable or non-refundable. If the required deposit payment is not received within the 5 working days period, Stay in Villa reserves the right to void the Vacationer’s booking request.
     
  2. PAYMENT METHOD
    Payments can be made by either credit card or bank transfer and you can choose the one which is easiest in your situation.
    • Wire Transfer. International telegraphic transfer to our bank account normally takes about three days. The amount transferred must include telegraphic transfer fees. If you choose to settle your payment by bank transfer, make sure that you allocate sufficient time before the due date and to mention “Full Amount Guarantee” when you submit the transfer instruction. In the case you are aware that your transfer payment may not reach our account in time, promptly notify us by sending (either emailed scan or fax) your transfer instruction receipt. Make sure that the receipt has bank’s authorization print-out.
    • Stay in Villa does not accept responsibility for the payment of bank charges or fees resulting from the transfer of fund. Any such charges or fees are the Vacationer’s responsibility and can not be deducted from payment. In the case arriving payment is slightly less than required in the INVOICE because of transfer fee, bank’s charge, currency loss, etc. you are required to pay the remainder either along with your final payment (if you are paying deposit) or in cash upon arrival.
    • Online Payment with Credit Card (Visa, Master, JCB and Union Pay) is acceptable. Online payment is the simplest and quickest way to settle your bill. Payment by credit card will be converted first into Indonesian Rupiah (IDR) based on the recent exchange rate. Based on Bank Indonesia's Regulation No. 17/3/PBI/2015 regarding the Mandatory Use of the Rupiah in Indonesian, all transaction is made in Indonesia must be settled in Indonesia currency. Therefore if you choose to pay by credit card, you will get your invoice pre-converted into Rupiah, refer to Property’s prevailing exchange rate. Credit Card Authorization is required to process the payment. As soon as we receive the full payment, we will issue a Confirmation Letter within 24 hour, advising you that the villa is locked for your stay. It can be subject to further (final) payment. Please be advised that the credit card billing report from your Bank might slightly different to what we charged as the exchange rate of your Bank might be different.                                                                                                                                                                                                                                                                               
  3. CANCELLATION POLICY & NO SHOW
    Vacationer shall inform Agent in writing of Vacationer’s intention to cancel the reservation. For reservations made through third parties, additional cancellation policies may apply. The cancellation policy is as follows:
    • If Cancellation notice is received sixty or more days (60+) prior to the check-in date, a cancellation fee equal to 30% of the Reservation Total will be forfeited and the balance will be refunded within 7 days from receipt of written cancellation. 
    • If Cancellation notice is received within thirty to sixty days (30-59) prior to the check-in date, a cancellation fee equal to 50% of the Reservation Total will be forfeited and the balance will be refunded within 7 days from receipt of written cancellation.
    • If Cancellation notice is received less than thirty days (0-29) prior to the check-in date, the full booking amount of rent and taxes will be forfeited. The Security Deposit and any pre-collected cleaning fees will be refunded within 7 days from receipt of written cancellation. As courtesy to our Vacationer, if Agent is able to rebook any portion of the canceled reservation, Vacationer will be refunded to the extent that Agent is able to re-book the Property.
    • The full booking amount of rent and taxes will be forfeited if Vacationer no-show.
    • Owner/Agent Cancellation Policy: In the unlikely event that the Property becomes unavailable due to unforeseen circumstances such as earthquake, excessive rain and flooding, plumbing or electricity problems beyond the control of the Agent, Owner and/or Agent may cancel this Agreement and refund in full to the Vacationer all payments made. Agent will assist in procuring similar alternative accommodation should this situation arise. Vacationer agrees that any claims against Owner/Agent arising out of performance or non-performance under this agreement shall be limited to a full refund of all consideration previously tendered by Vacationer.
    • In the event of refund, deposit or payment that has already been paid will be refunded in full less USD 100 or 5% of money received whichever is greater 
       
  4. OCCUPANCY
    The Property is for the sole use as a personal vacation residence for families and responsible adults. Occupancy is restricted to the number of people listed at the time of booking. Vacationer acknowledges that they will personally occupy the Property for the entire length of stay and will not sublet. Vacationer shall not use the Property for any illegal or unlawful purpose, nor shall the Property be used in a fashion that disturbs or offends the neighbors.
     
  5. CHECK-IN AND CHECK-OUT
    Most villas have standard Check-In time at 2:00 p.m. or after, Check-Out time is by 12:00p.m (noon). Vacationer will vacate the Property by Check-out time at the end of his or her scheduled reservation. Vacationers arriving before the 2:00 p.m. check-in time are not guaranteed that the property will be ready  for occupancy and will not be allowed in the rental if housekeeping is there preparing the home for occupancy. Should you like to secure a late check-out until 6pm a 50% charge from the nightly rate shall be applied. Owner will also typically require a copy of each Vacationer passport and/ or other form of identification as required by Indonesian Immigration. Please comply with this requirement as it is also for your safety.
     
  6. SECURITY DEPOSIT
    A security deposit may be payable directly to the Owner or owner’s representative immediately upon arrival at your selected villa. The standard security deposit required for each private luxury villa is stated in the property description; however the Owner has the right to impose different requirements on a case by case basis. Access to the Property may be refused if security deposit is not paid in full. When the security deposit is required to be paid in cash, or when a non-standard security deposit applies, Stay in Villa will inform the Vacationer in advance of the amount payable and any other conditions. The security deposit will normally be refunded at the end of the rental period, after deducting: all additional expenses incurred on the Vacationer’s behalf (e.g. additional charges for goods, services and staff, which have not been directly paid by the Vacationer, and telephone and internet charges, if applicable) and the cost of replacement or repair for any loss or damage to the Property or its surrounds or contents caused during the rental period. If this cost cannot be reasonably determined prior to the Vacationer’s departure, the Owner or the owner’s representative is entitled to withhold a reasonable estimate from the Vacationer’s security deposit, and will return any balance to the Vacationer as soon as possible after the actual cost has been determined.
     
  7. RATES
    • ​​All prices quoted on Stay in Villa are in USD, unless stated otherwise.
    • All prices are fully inclusive of all taxes in Bali and are inclusive of all the standard inclusions (breakfast, transfers, free wifi, etc.) stated on the Booking Confirmation Voucher. The Vacationer is advised to check the inclusions carefully as not all villas offer the same inclusions and each villa may offer various different rates with different inclusions.
    • The prices are subject to change daily due to either the fluctuation in the exchange rate and/or if the Owner decides to alter the rates. Stay in Villa is not responsible if the Vacationer misses out on a low rate that was previously advertised.
    • In some cases, it is possible for Stay in Villa to strive for you in order to get the better rates than published online so it can match your budget
       
  8. COMPLAINTS
    Stay in Villa are committed to offering you the best accommodation available. However, should the Vacationer have a cause for complaint whilst at the villa, then the Vacationer should contact Stay in Villa immediately by phone or email. Most complaints can be resolved by the Owner or the villa staff except where circumstance are beyond their control. Please note that there is very little that can be done if the Vacationer does not contact Stay in Villa whilst he/she is at the villa and only raises his complaint to Stay in Villa once he has returned home. In such circumstances Stay in Villa shall not be liable for any compensation or refund. 
     
  9. REPORT DAMAGE AND NEED FOR REPAIRS
    Agent and Owners make every effort to have all equipment and appliances in working order prior to your arrival. In the event that something has been overlooked and there is a malfunction with something in the rental, it is your responsibility to let us know immediately so we can make every effort to get the repair work done as soon as we are able. If you do not report the problem we cannot get it fixed. If a repair is needed and it was not possible to complete before your arrival, we will remedy the problem as soon as we can get a service person to fix the problem. Vacationer (s) agrees that Stay in Villa, it agents, or hired repair person may enter the premises for the purpose of making necessary repairs or maintenance when deemed necessary by rental agent or owner. Should a repair person conclude that equipment is in working order, or that failure was due to the actions of the Vacationer, then the charge for the service call will be billed to Vacationer and Vacationer agrees to pay the charge. No refund or rent deduction will be made due to failure of such equipment. *As a courtesy, Vacationer agrees to contact Stay in Villa if something gets broken during your stay, i.e. a glass or plate or anything, please let us know by calling us before your departure. It helps us keep track of inventory so we are sure sufficient supplies are being provided for all of our Vacationer.
     
  10. LOST AND FOUND
    Stay in Villa is not responsible for any lost, stolen, or damaged personal items. Any personal property SiV discovers after Vacationer’s departure will be held by SiV for 30 days from the date the item was found. If Vacationer does not claim his or her lost personal property items within the 30-day period, SiV will donate or dispose of the personal property items. Vacationer will pay for any and all shipping and handling charges necessary to return Vacationer’s items of personal property.
     
  11. NOISE AND DISTURBANCE 
    Vacationer will behave in a civilized manner and will be a good neighbor respecting the rights of surrounding property owners and Vacationer. Vacationer will not disturb, annoy, endanger, and/or interfere with surrounding property owners and Vacationer. We have a zero tolerance policy for any house, fraternity and/or bachelor/bachelorette type parties with excessive use of alcohol in or at the property. If there is damage or we are called for a disturbance related to such activity, we will call the local law enforcement to handle the situation. If excessive noise or disturbances occur resulting in notification by police or neighbors, Vacationer will vacate the Property and will forfeit the reservation and any monies paid. Quiet hours are from 10 p.m. to 8:00 a.m.
     
  12. PROVISION
    Self-catering accommodations require that the Vacationer supply all provisions and consumables necessary for daily living. The staff at Property may accommodate any reasonable requests to purchase provisions on the Vacationer’s behalf, and this will be charged to the Vacationer’s account. 
     
  13. RESPONSIBILITY
    The descriptions, assessments and/or ratings of Property (ies) and surrounding locations that Stay in Villa publishes or gives to the Vacationer are provided in good faith and in the belief that they are accurate based on the latest information received. However, Stay in Villa cannot be held responsible for any modifications to the Property (ies) or inaccuracies. Where Stay in Villa publishes or refers to descriptions, assessments and/or ratings of the Property either by Stay in Villa or by third parties, these ratings are for information purposes only and Stay in Villa will not be held responsible for any reliance placed on these ratings.
     
  14. JURISDICTION
    This agreement will be governed by the laws of INDONESIA. In the event of controversy arising from the booking and property rental that cannot be resolved amicably between the parties, both parties agree to exclusively refer the matter to the court of Indonesia to be resolved. By making its booking request, the Vacationer agrees that these terms and conditions have been read, understood and have been accepted and agreed to by the Vacationer without reservation and without exception. If any of the conditions of this Bali Villas rental contract are or become or are deemed to be invalid, or if there is any omission from any terms and conditions, the remaining terms and conditions will remain valid and enforceable and cannot be contested.
